Happitude Terms & Conditions of Use Agreement

These terms and conditions ("Terms") govern your use of online yoga content and participation in studio classes provided by Happitude ("Company," "we," "us," or "our"). By accessing or using our website, purchasing our products or services, attending our classes, workshops, or events, you agree to abide by these Terms. Please read these Terms carefully before using our services. If you do not agree to these Terms, please refrain from using our services.

 

Use of Content:

 

1. Ownership: All content provided by the Company, including but not limited to videos, text, graphics, images, and audio recordings, is the intellectual property of the Company and is protected by copyright laws.

 

2. License: By purchasing our products or services, you are granted a limited, non-exclusive, non-transferable license to access and use the content solely for your personal, non-commercial purposes. You may not reproduce, distribute, or modify the content without our prior written consent.

 

Limitation of Liability and Disclaimer:

 

3. No Medical Advice: The Company's content and services are intended for general informational and educational purposes only. They do not constitute medical, psychological, or professional advice. Consult with a qualified healthcare professional before beginning any new fitness or wellness program.

 

4. Assumption of Risk: Participation in yoga or fitness classes or any physical activity carries inherent risks. By using our services, you voluntarily assume all risks associated with such activities, and you agree to release the Company and its instructors from any liability for injuries or damages that may occur during or after class.

 

5. No Warranties: We make no representations or warranties, express or implied, regarding the accuracy, completeness, or suitability of our content. We do not guarantee that our services will be error-free or uninterrupted.

 

Registration and Purchase:

 

6. Registration: To access our online content and classes, you may be required to register for a membership account. You agree to provide accurate and complete information during the registration process and to keep your login credentials confidential.

 

7. Payment: Payment for our products and services must be made in accordance with our pricing and payment terms.  All Credit Cards will be processed in Canadian Dollar at the time of payment. Happitude is not responsible for any fees, charges, exchange rates or additional charges levied by individual financial institutions or Credit Card companies.

 

Waiver Form Terms and Conditions:

 

8. Waiver of Liability: Prior to participating in any in-person classes, workshops, or events held by the Company, you may be required to sign a waiver form. By signing the waiver, you acknowledge and accept the inherent risks associated with physical activities and release the Company from liability.

 

Terms and Conditions of Use:

9. Compliance: You agree to comply with all applicable laws and regulations while using our services and refrain from engaging in any prohibited activities, including but not limited to unauthorized access, data scraping, or harassment of other users.

Internet Email:

10. Communication: By using our services, you consent to receive communication from us via email. You can opt out of promotional emails at any time by following the unsubscribe instructions provided in the email.

Payment for Products and Services:

11. Billing Information: You agree to provide accurate billing and payment information when making a purchase. If payment is not received or is declined, we may suspend or terminate your access to our services.

 

Return and Refund Policy:

 

12. Refunds: All class passes and memberships are non-transferable, non-refundable and become active on the date of first use. Five Class Packs for online and in studio classes are void after three months from the date of activation.

Workshop Registration:

 

13. Cancellation: Workshop deposits and payments may be cancelled up to 48 hours in advance with a 25% admin fee.  Refunds cannot be processed online, please contact us directly.
 

Private Class Cancellation Policy:

 

14. Cancellation: Private class cancellation requires a minimum of 48 hours notice via email.  If less than 48 hours notice is given to Happitude, a cancellation fee equivalent to the rate of one private class will be charged to the client’s account.

Use of Your Information:

15. Privacy: At Happitude, we are committed to protecting your privacy and safeguarding your personal information. This Privacy Policy outlines our practices concerning the collection, use, and protection of your personal information when you use our website or services.

 

16. Information We Collect

i. Personal Information: We may collect personal information, including but not limited to your name, email address, mailing address, phone number, payment information, and other information you provide voluntarily when you use our services or communicate with us.

 

ii. Non-Personal Information: We may also collect non-personal information, such as browser type, device type, IP address, and usage data when you access our website or use our services.

 

17.  How We Use Your Information

i. Providing Services: We use your personal information to provide you with our online yoga classes and services, process payments, and communicate with you about your account.

 

ii. Customer Support: We may use your information to respond to your inquiries, requests, or comments.

iii. Marketing: With your consent, we may send you promotional emails about our services, events, or other updates. You can opt-out of receiving these emails at any time.

18. Sharing Your Information

i. Third-Party Service Providers: We may share your personal information with trusted third-party service providers who help us operate our website, process payments, or provide customer support. These service providers are required to protect your personal information and use it only for the purposes we specify.
